Die skepping (en die reg): H.G. Stoker se Skeppingsfilosofie
Abstract
H.G. Stoker’s legal theory is embedded in his teachings regarding creation. Stoker’s philosophy of the idea of creation has important implications for legal science. Three aspects in particular are of importance: Firstly, he attaches the study of law to the light of the motive of creation, man’s fall into sin and man’s redemption through the death of Christ contra the humanistic perspectives on law. Second ly, Stoker’s theory adds a dimension in addition to the distinction between the idea of law and the concept of law. The philosophy of the idea of creation recognizes the ontic law according to the order of creation and provides more encompassing perspectives on issues related to law and justice. Thirdly, Stoker’s approach has the benefit that it tempers the humanistic emphasis on human reason by introducing the Biblical perspective of knowledge, human thought and revelation in an integral sense.
